In October, the EEOC sided with McCusker, concluding that the Catholic school discriminated against her because of her pregnancy and urged the school to settle the complaint.
EEOC Commissioner Stuart Ishimaru was the lone dissenter in a three-to-one vote to downgrade several district offices.
After investigating the claims of store worker Toya Stamps, the EEOC says in its suit that the Ohio-based retailer of overstock and other discounted items must "institute and carry out policies, practices and programs which provide equal employment opportunities for women.
