This, it seems to us, is a significant concession to a certain incalculability of justice that retributivist theorists would be loath to concede.
Dickens is reminding us of the incalculability, and frequent frivolity, of human motivation, which perhaps explains why the direst of penalties does not exert the effect upon the conduct of a class of susceptible persons (and murder is always an infrequent crime, even in countries such as the United States, where it is more frequent than in others) that the person who thinks of man as a being that rationally weighs up alternatives expects.
