At the base of the present system of society is to be found the
property right. And this right of the individual to hold property is demonstrated, in the last analysis, to rest solely and wholly upon MIGHT.
He hated the shams and the hypocrisies of it and with the clear vision of an unspoiled mind he had penetrated to the rotten core of the heart of the thing--the cowardly greed for peace and ease and the safe-guarding of
property rights. That the fine things of life--art, music and literature--had thriven upon such enervating ideals he strenuously denied, insisting, rather, that they had endured in spite of civilization.
Was the idea of
property rights dominating his thoughts?
The death of his only son, Hamnet, in 1596, must have been a severe blow to him, but he obtained from the Heralds' College the grant of a family coat of arms, which secured the position of the family as gentlefolks; in 1597 he purchased New Place, the largest house in Stratford; and later on he acquired other large
property rights there.
The lube shop sued based on inverse condemnation, contending the unrepaired sinkhole amounted to a government "taking" of its
property right to have accessible customer access.
Such revision does not rule out the common libertarian dictum of a perpetual claim on (previously unowned) property as illegitimate per se, but rather as one extreme on a spectrum of what I shall call "temporal attitudes" toward
property rights. (4) in short, i argue that because the human improvements on unowned resources (which grant ownership) depreciate over time, a consistent labor theory of
property rights must also consider a temporal dimension for retaining a
property right over resources.
In Pakistan intellectual
property right is not a new Law, it was a part of Pakistani constitution.
The mutual exclusivity principle holds that if one person's
property right is legally valid, no one else can hold valid a
property right that contradicts it.
