260 26-0 Subdivision (c) is amended to clarify that a state agency filing a caveat need not designate an agent for service of process, and to provide that a caveator who is not a resident of the county where the caveat is filed must designate either a resident of that county or an attorney licensed and residing in Florida as the agent. A prudent caveator under the statute should assert in the caveat that he or she is an "interested person"--someone who reasonably expects to be affected by the probate or lack of probate of the will. 2123, likely requires the caveator to challenge the will and the qualifications of the personal representative before a personal representative is authorized to take actions on behalf of an estate. |
