Most often found in a declaration of condominium or covenants, conditions, and restrictions
(CCR), leasing restrictions, leasing approval requirements, and, more often than not, restrictions on the frequency and duration of leases and guest occupancy of units reflect a general discord existing between resident owners and nonresident owners and their lessees because of what is perceived as differing interests in the use and maintenance of property.
Lemmelin said these boards and their property managers can be sued from all sides--by association members, employees, regulators, volunteers and individual board members--for a variety of issues, including mismanagement; conflict of interest; housing discrimination; breach of contract; acts beyond authority granted by covenants, conditions, and restrictions
; and violation of certain federal and state laws.
They argued that the group home would violate their subdivision's covenants, conditions, and restrictions
(CC&Rs), which limit the use of homes to single-family residences.
