The United States district courts agree that sanctions may be imposed pursuant to Rule 11 for wrongful removal, but vary on whether Rule 11 sanctions are payable to the court or to the non-moving party, whether they can be imposed against only the removing defendant, only the attorney who filed the petition for removal, or both, and on the application of mitigating factors such as the non-removing party's failure to properly disclose the underlying facts or object to the wrongful removal.
